WINDOW TRENDZ NEW ZEALAND LTD
TERMS OF TRADE – Effective 01/01/2025 (Version 2.0)
These Terms of Trade govern all supplies of products and services from Window Trendz New Zealand Ltd and associated brands. Window Trendz New Zealand Ltd will meet its obligations under the Consumer Guarantees Act 1993.
1. Definitions
1.1 “Window Trendz New Zealand Ltd” refers to the Company T/A as stated on the Quote, Order Confirmation, or Invoice.
1.2 “Products” means goods supplied by or through Window Trendz New Zealand Ltd to you.
1.3 “Services” means any service supplied by Window Trendz New Zealand Ltd that is not a supply of products.
1.4 “Quote” means a document that records an offer by Window Trendz New Zealand Ltd to supply products and/or services.
1.5 “GST” means Goods & Services Tax at the rate payable in New Zealand.
2. Quotes
2.1 A printed quote is valid for 30 days from the date printed on the quote.
2.2 All quotes based on house plans or your own measurements are subject to an on-site check measure unless written instruction is provided to proceed without it.
2.3 Acceptance of a quote by email, text message, or any written form constitutes acceptance of these Terms of Trade.
3. Orders
3.1 Upon acceptance of a quote, an Order Confirmation will be issued with an estimated installation date. This date is indicative and may change due to supplier or freight delays.
3.2 No compensation or discount is available for unforeseen delays or errors with orders.
3.3 If a product or fabric becomes discontinued prior to manufacture, Window Trendz reserves the right to offer a substitute of similar quality and value or refund the affected portion.
4. Backorders
If a product is unavailable or out of stock, customers will be advised with the option to wait, change, or cancel their order.
5. Payment Terms
5.1 A 50% deposit is required before an order is processed. Paying the deposit signifies acceptance of these Terms of Trade.
5.2 The balance is due upon installation.
5.3 Payments made by credit or debit card attract a surcharge of 2%, reflecting our cost of acceptance.
5.4 Late payments incur interest at 2.5% per month. All goods remain the property of Window Trendz until paid in full.
5.5 Costs associated with debt recovery, including collection or solicitor fees, are payable by the customer.
5.6 For supply-only orders, full payment is required prior to collection.
5.7 Orders cancelled after processing are subject to restocking or labour fees. Once fabric has been cut, cancellation is not possible.
5.8 If installation is delayed at the buyer’s request for more than two weeks, up to 10% of the value may remain unpaid until completion.
6. Ownership and Risk
6.1 Title to goods remains with Window Trendz until full payment is received.
6.2 Risk in the goods passes to the customer upon delivery or installation, whichever occurs first.
7. Subcontractors and Installers
Where subcontractors are engaged for delivery or installation, Window Trendz remains responsible for overall workmanship quality but is not liable for incidental damage or delays beyond its control.
8. Warranty
8.1 Workmanship on manufactured products, including curtains and roman blinds, is guaranteed for two years.
8.2 Installation workmanship is guaranteed for two years from installation date.
8.3 Blind componentry is covered per product schedule (usually 2–5 years).
8.4 No claims for fading on leading edges of curtains or blinds exposed to sunlight will be accepted. A sunscreen blind is recommended.
8.5 Venetian blinds are not designed to be lifted daily; sagging from frequent lifting is not a fault.
8.6 Roller blinds may ‘vee’ or ‘cup’; this is normal performance within specification.
8.7 Imperfections visible only beyond 1.2 m under daylight are acceptable per BMAA standards.
9. Consumer and Business Purchases
9.1 Window Trendz complies with the Consumer Guarantees Act 1993 and Fair Trading Act 1986 for residential customers.
9.2 Where goods or services are acquired for business purposes, these Acts do not apply.
10. Liability
10.1 Liability will not exceed the invoice amount for the works completed.
10.2 Window Trendz is not responsible for customer-provided measurements or pre-existing site issues.
10.3 We shall not be liable for indirect, incidental, or consequential loss or damage, including site-related risks.
11. Force Majeure
Window Trendz shall not be liable for failure to perform obligations caused by events beyond its control, including natural disasters, strikes, pandemics, supplier failures, or transport interruptions.
12. Privacy and Data Use
Window Trendz collects and stores customer information solely for the purpose of quoting, supplying, and servicing products. Personal information is handled in accordance with the Privacy Act 2020 and will not be shared with third parties except as required to fulfil orders or by law.
13. Photographic Rights
Window Trendz may request to photograph completed work for promotional use. Customers who do not wish their projects to be featured should advise us. Where permission is given, we may use the images in our advertising.
14. Fabric Information and Care
14.1 All fabrics deteriorate under UV light. Sunscreen blinds or linings are recommended in sunny locations.
14.2 Fabrics may move up to 3% (natural) or 5–6% (synthetic) due to atmospheric conditions. This is normal.
14.3 Rotate curtains periodically to reduce sun fading.
14.4 Sometimes Roller blind fabric can ‘Vee’ or ‘Cup’ interrupting visual aesthetics. This is intrinsic with roller blind fabric and perfectly normal. On some occasions this is further exacerbated by light source, size and orientation. Window Trendz will not accept liability where in its opinion, or that of the manufacturer, the product is performing within specification and expectation
15. Lead Times
Typical lead times: Curtains 6 weeks, Blinds 4–6 weeks, Shutters 3 months. Timelines may vary during peak demand.
16. Intellectual Property
All designs, trade names, and branding remain the property of Window Trendz and may not be reproduced without written consent.
17. Dispute Resolution
Disputes will first be addressed in good faith. If unresolved within 14 days, the matter may proceed to mediation and, failing that, arbitration under the Arbitration Act 1996 (NZ).
18. Amendments
Window Trendz reserves the right to amend these Terms at any time. Updates take effect immediately upon posting or notification. Continued engagement implies acceptance.
